Flight Delayed or Cancelled in Argentina? Your Rights as a Passenger

In Argentina, air passenger rights are set out in the general conditions of the air transport contract, published by the National Civil Aviation Administration (ANAC). The long-standing Resolution 1532/98 was replaced in 2024 by updated rules, and ANAC summarizes the current passenger rights on its website. These rules focus on care and rebooking, not on a fixed cash amount.

Early cancellations and schedule changes

If the airline cancels a flight up to 30 days before the scheduled date, it must offer one of these:

  • A seat in the same fare class on its next flight with availability to the same destination
  • Transfer of your ticket to another airline with an agreement for disruptions
  • Rerouting to your destination with the same airline, a partner airline, or another means of transport

If none of these works for you, you can ask for a refund of the ticket. For schedule changes caused by the airline, care rules apply unless you were told at least 2 weeks before, or between 2 weeks and 7 days before with an alternative that gets you to your destination.

Care during delays ("servicios incidentales")

When a departure delay is attributable to the airline, care depends on its length:

  • Up to 4 hours: no care requirement, except at night (midnight to 6 AM), when the 4–8 hour rule applies.
  • More than 4 and up to 8 hours: sufficient meals and refreshments for the wait.
  • More than 8 hours: meals and refreshments, plus lodging and transfers. The airline must also work to rebook passengers who miss a connection.

For cancellations, the airline must work to rebook you on its next flight, transfer your ticket, or reroute you, including onward connections.

Exceptions

The airline does not have to provide these services when the disruption is due to weather, unforeseeable events, or force majeure, though it must still give you accurate information, or when the change was announced at least 15 days before the original departure.

Main airports and airlines

Airports include Buenos Aires Ezeiza (EZE), Buenos Aires Aeroparque (AEP), Córdoba (COR), Mendoza (MDZ), Bariloche (BRC), Iguazú (IGR), and Salta (SLA). Airlines include Aerolíneas Argentinas, Flybondi, and JetSMART.

Where to complain

Put your complaint to the airline in writing first. ANAC's passenger rights page is at argentina.gob.ar/anac/pasajeros. For consumer disputes you can also contact Argentina's consumer protection authority (Defensa del Consumidor): argentina.gob.ar/produccion/defensadelconsumidor.

FAQ

Does Argentina have fixed cash amounts for delays? No fixed table like EU261. The rules set care, rebooking, and refund options. Other damages are a matter for Argentine consumer and civil law.

What if I accept another flight? ANAC notes that passengers who voluntarily accept one of the offered alternatives may not be able to make further claims about that change, though care still applies.

Do the rules cover night delays? Yes. A delay of up to 4 hours between midnight and 6 AM triggers meals and refreshments.
