UK Flight Delay Rights Letter (UK261): How to Write to Your Airline
After Brexit, many flights from the United Kingdom are covered by UK261, the UK’s version of the familiar EU air passenger rules. If your flight was delayed or cancelled, a clear letter to the airline is usually the first step. Delay Draft helps you create a UK delay rights letter that you send. We do not file claims with the airline, ADR bodies, or the CAA for you, and we are not a law firm.
This page is general information only. Whether UK261 may apply—and what care or other remedies may follow—depends on your route, delay length, and cause. Delay Draft does not promise compensation, refunds, or any approval.
When UK261 may apply
According to UK Civil Aviation Authority (CAA) and Citizens Advice guidance summarised for travellers, UK261 generally may apply when:
- You depart from a UK airport, on any airline; or
- You fly into the UK from outside the UK on a UK or EU airline (with further nuances for some EU-related itineraries)
Flights between the UK and the EU can raise both UK261 and EU261 questions. Often only one framework is used for the same disruption. Confirm your route against current CAA guidance. Our UK261 hub covers airports, thresholds, and pound amounts at a high level; EU261 overview covers the EU side.
Delay Draft does not decide eligibility for your booking.
Care duties vs. other remedies
UK261 includes a duty of care when departure delays reach certain time thresholds that vary by flight distance (shorter flights trigger care sooner than long-haul). Care typically means food and drink in proportion to the wait, and hotel plus transport for overnight delays—when the duty applies.
Separate from care, UK261 sets fixed amounts in pounds for certain long arrival delays and cancellations when the disruption is within the airline’s control. The CAA notes these amounts are not paid automatically; you usually must ask. Distance bands and reduced amounts for some long-haul delays matter. Nothing on this page promises that any pound amount is owed in your case.
If a delay becomes very long, refund or re-routing choices may also arise. Check official CAA wording for the thresholds that may match your flight.
Extraordinary circumstances
Airlines may argue that a disruption was caused by extraordinary circumstances—for example severe weather, air traffic control decisions, security risks, or certain infrastructure failures. When that argument succeeds, fixed compensation amounts may not apply, though care duties can still matter.
Ask the airline for the cause in writing. Recent major UK events (such as widespread ATC failures or airport closures) are often discussed in this category, but every case is fact-specific. Delay Draft cannot classify your delay or guarantee any result.
Write to the airline first; CAA / ADR if unresolved
- Write to the airline first with a dated letter or formal complaint form: booking reference, flight details, timeline, reason given, care/expenses, and what you want reviewed under UK261.
- Keep copies and any reference numbers.
- If you are not satisfied with the final response—or the airline has not replied within the period the CAA describes (commonly discussed as about eight weeks)—check whether the airline belongs to an approved Alternative Dispute Resolution (ADR) scheme, or contact the CAA’s passenger advice channels for next steps.
ADR and CAA processes are options you explore if the airline path fails. They do not guarantee payment. Delay Draft is not part of those processes.
