Delay Draft lost, delayed or damaged baggage claim letter
Bag missing, late or broken? Delay Draft writes a clear, dated baggage claim letter that cites the rules that may apply to your trip, so you can send it to the airline yourself. The airline decides; we do not promise any outcome.
Rules that may apply
- International trips: the Montreal Convention may apply. Since 28 December 2024 the airline's baggage liability limit under Article 22 is 1,519 Special Drawing Rights per passenger (a maximum, not a set amount).
- Deadlines under Article 31: report damage in writing within 7 days of getting the bag, and a delay within 21 days of the bag being delivered. File a baggage report (PIR) at the airport if you can.
- EU airlines apply the Montreal Convention rules through Regulation (EC) 889/2002.
- US domestic flights: DOT rules let airlines limit liability to no less than $4,700 per passenger, and a checked-bag fee may be refunded for a significantly delayed bag (over 12 hours domestic; 15 or 30 hours international) once you have filed a report.
- ICAO: Montreal Convention limits (2024)
- US DOT: Lost, delayed or damaged baggage
- EU: Air passenger rights (baggage)
FAQ

- What should I attach?
- Boarding pass, bag tag, the baggage report (PIR), receipts for things you had to buy, and photos of any damage.
- Do you contact the airline for me?
- No. Delay Draft writes the letter; you send it yourself. We are not a law firm.
