Rules that may apply

  • EU: Regulation (EU) 2021/782 (in force since 7 June 2023) may apply. Article 19 sets minimum compensation of 25% of the ticket price for a 60–119 minute delay and 50% for 120 minutes or more, paid within one month of the request.
  • Exceptions: the company does not have to pay if the delay came from certain extraordinary circumstances (e.g. extreme weather), passenger fault, or some third-party actions. Staff strikes are not one of those exceptions.
  • UK: each train company runs Delay Repay. Many pay from 15 minutes late, some from 30. Claims are usually due within 28 days.
  • US (Amtrak): there is no federal delay-compensation law like the EU's; the letter asks Amtrak to review your case under its own policies.
